Según el agente, ésta información le llegó inicialmente en la declaración que hizo J., la hija de Ana Julia, hablando de su propio padre. Éste comentó que fueron dos episodios de vómitos y malestar general graves, que posteriormente no volvió a tener, pero que tras conocerse lo ocurrido con Gabriel lo recordó.
La acusación ha puesto sobre la mesa que Ana Julia había buscado en su ordenador plantas venenosas, y que en dos ocasiones, cuando ella se quedó al cargo de Gabriel, éste se puso enfermo y tuvieron que llevarlo al médico, y todo tras tomar unos batidos de Oreo con hierbas preparado por la acusada.
