El letrado señala que "nos llamó la atención al emitirse el veredicto la carencia de motivación para rechazar la agravante de ensañamiento, el único pedimento de esta acusación que el jurado no había aceptado pese a que está absolutamente claro, y pensamos en recurrir pero valoramos que eso pasaba por el hecho necesariamente de poner nuevamente a la familia en la repetición del dolor y llegamos a la conclusión de que la agravante de alevosía, si bien no cubría todas la expectativas, permitía la aplicación de la prisión permanente revisable sin mayores problemas".
Torres ha criticado a la magistrada que presidió el tribunal del jurado compuesto por siete mujeres y dos hombres, que les aleccionara sobre qué es el ensañamiento, pero "fue tal la subida de listón que era prácticamente imposible que el jurado pudiera entender que hubiera ensañamiento porque el caso concreto hablaba de cortar la lengua y un dedo y enseñarlo a la víctima”. Ha considerado que "colocó a los jurados en una tesitura de difícil salida que les hizo tirar por el sitio más fácil: dar credibilidad a los forenses que habían hecho la autopsia, que iba en la línea de la indicación que la magistrada acababa de dar".
