Es un proceso que viene de largo. En el año 2000 unos agricultores, ante la propuesta por parte de la Junta de incluir las artineras en la Red Natura, arrasaron con los arbustos protegidos que ponían en peligro la construcción de invernaderos. El Ayuntamiento de El Ejido con su exalcalde a la cabeza, el juzgado y a la espera de sentencia por el robo sistemático de las arcas municipales, Juan Enciso, apoyó estos movimientos de tierras que Ecologistas En Acción denunció en 2002. Algunos agricultores agraviados por la protección ambiental que le impedía construir más infraestructuras, recurrieron el Plan de Ordenación Urbana de El Ejido, y el Tribunal Superior de Justicia de Andalucía les dio la razón en 2008 al declarar que esas fincas eran superficie agrícolas de regadío.

12 años después, en octubre de 2020, la Junta, con un nuevo gobierno y otra visión sobre los espacios naturales protegidos, publicó y aprobó la orden de la descatalogación parcial en base a esta sentencia, y los ecologistas lo volvieron a denunciar, y la Comisión Europea, cuatro meses después, le recordó al gobierno autonómico en un informe, que no tiene autoridad para ordenar su descatalogación.
El proceso sigue en marcha a la espera de que el TSJA corrobore la primera sentencia, pero la Junta ya ha sido llamada al orden por haberse extralimitado. Así que si el TSJA ratificase al magistrado, Rafael Puya, que dictó la sentencia en 2008, la justicia europea caería contra nosotros. Algo que los grupos ecologistas tuvieron claro desde un principio y que si nuestros políticos y magistrados no se dejasen llevar por otros intereses diferentes al bien común, también lo habrían tenido. Mientras todo se dirime, el ecosistema ya fue arrasado, y nadie se hará responsable de ello. Un sistema lento e ineficaz que hace justicia tarde y donde deja al descubierto la impunidad y la poca vergüenza con la que algunos se manejan.

El proyecto no es definitivo. Esta semana se ha acabado el plazo para presentar las alegaciones a la solicitud a la D. T. de Desarrollo Sostenible para la concesión de ocupación del Dominio Público Marítimo Terrestre, y confiamos en que no se autorice, porque el proyecto presentado es un despropósito en toda regla y tiene claros síntomas de ser un corta y pega de un trabajo que comenzaron en el 2015.
