Según indica VOX, en el artículo 59 del Real Decreto Legislativo 2/2004 que aprueba el Texto Refundido de la Ley de Haciendas Locales, tanto el Impuesto sobre el Incremento de Valor de los Terrenos de Naturaleza Urbana (Plusvalía), como el de Instalaciones, Construcciones y Obras quedan configurados como potestativos, es decir de libre imposición para las Entidades Locales.
Asimismo, señala la incoherencia del Partido Popular al votar en el Congreso contra este impuesto y, sin embargo, traer al último pleno del Ayuntamiento de Almería la reforma de la ordenanza fiscal n.º 6 de la plusvalía.
