La Policía Científica descarta un rebote y achaca al sargento acusado el balazo mortal a un soldado
El Tribunal Territorial Militar Segundo con sede en Sevilla se encuentra llevando a cabo un juicio con el objetivo de determinar el responsable de la muerte de un legionario mallorquín de 21 años, quien recibió un disparo de fusil durante un ejercicio de la Brigada de la Legión realizada en marzo de 2019 en el campo de maniobras de Agost (Alicante). El Ministerio Público ha acusado a dos tenientes, un capitán y un sargento, y el sargento Saúl Antonio Guil se encuentra siendo acusado de haber realizado el disparo mortal. El Ministerio Público ha solicitado para él siete años, cinco meses y 15 días de prisión.

Durante la sesión de este miércoles, se han presentado cinco miembros de la Policía Científica de la Guardia Civil de Madrid, quienes han confirmado los informes según los cuales el proyectil que mató al soldado provino del fusil del sargento inculpado.
Los miembros de la Policía Científica han confirmado, mediante aspectos de trayectoria, distancia, componentes químicos y otros elementos, que el proyectil que mató al efectivo fallecido procedía del fusil que usaba el sargento de la Brigada de la Legión Saúl Antonio Guil. Esta conclusión descarta la posibilidad de que el impacto mortal de bala se deba a un "rebote" de un proyectil, como se había planteado por el principal inculpado en esta causa.

Todo sucedió el 25 de marzo de 2019 en el campo de tiro de Agost, donde el pelotón que comandaba el sargento de la Brigada de la Legión Saúl Antonio Guil realizó un ejercicio de asalto a un merlón con cuatro blancos.
Según la Fiscalía, el sargento seguro al pelotón sin previo aviso que se dirigiera al faldón de la montaña a las doce para enfrentarse al enemigo. El binomio más adelantado fue subido a la cima del merlón y, desde la posición del cuerpo a tierra, se abrió fuego. El sargento se encontró de pie en el merlón a una distancia de 12,5 metros de la víctima, Alejandro Jiménez, quien estaba arrodillado en el flanco izquierdo, con su fusil apuntando hacia abajo. El proyectil impactó en el culatín del fusil de la víctima, desestabilizándose pero sin alterar su dirección, ya continuación golpeó el cuerpo de la víctima, causándole una herida fatal en el hemitórax derecho.

Al respecto, el sargento acusado en el juicio declarado que, si bien hubo disparos durante el asalto inicial, no había hecho "fuego al segundo enemigo" que él mismo había definido. Reconoció ser consciente de los informes periciales que indicaban que el proyectil que había alcanzado al legionario fallecido provenía del fusil que él portaba, y que en el merlón asaltado se habían localizado siete casquillos de proyectiles disparados con dicha arma. Sin embargo, alegó que los informes eran "totalmente erróneos". Afirmó que, sin ser experto en balística, el impacto recibido por el soldado fallecido debió haber producido por un rebote de una bala y que el capitán A. Cabello, el teniente R. Gascón y el otro teniente identificado como PF, llegaron a la Misma conclusión.

El Teniente R. Gascón, responsable del batallón que operaba al lado de donde el Sargento Guil estaba al mando en el sector derecho del campo de maniobra, también declaró como acusado que después del "accidente" él descubrió que el soldado herido por un disparo había sido victima del "rebote" de una bala. "Fue la opción más lógica", aseguró el oficial acusado también en el juicio, por su supuesta participación en los hechos y también por la supuesta "alteración del escenario" del incidente.
