De igual forma CSIF advierte que el teletrabajo se ha de llevar a efecto con las absolutas garantías y una debida regulación que evite situaciones como la conexión permanente o casi permanente a la que están expuestas las personas que optan por la modalidad no presencial en su lugar de trabajo y que podrían derivar en problemas de sueño, aumento del nivel de estrés, jornadas laborales que se alargan en el tiempo, fatiga informática o progresivo aislamiento social, entre otras situaciones.

CSIF reclama que el desarrollo normativo que regule el teletrabajo en Andalucía debe llevarse a efecto de forma inminente con el fin de establecer una regulación real de esta fórmula de trabajo en la Administración pública de nuestra comunidad, garantizando con ello la prevención de riesgos laborales en esta modalidad laboral. En este sentido, critica la parálisis que la Administración andaluza muestra ante este asunto, pese a la insistencia por parte de la central sindical.
A nivel nacional, el pasado 9 de febrero CSIF presentó una demanda por la vía de lo Contencioso Administrativo contra el Ministerio de Hacienda y Función Pública ante el retraso injustificado del desarrollo del teletrabajo en la Administración General del Estado por incumplimiento del acuerdo firmado en abril de 2021 sobre ello. Desde entonces está pendiente la aprobación del Real Decreto que debe establecer su regulación.

Para CSIF es fundamental que los accidentes ocurridos en el trascurso de una jornada laboral de teletrabajo y, por tanto, en el domicilio particular, sean catalogados como accidente laboral y no como contingencia común. Precisamente esta petición del sindicato coincide con el contenido de las últimas sentencias sobre accidentes de personas mientras desarrollaban sus funciones laborales en la modalidad de teletrabajo.

Los accidentes se produjeron en sus domicilios, pero en horario laboral y mientras realizaban su actividad profesional, por lo que la Justicia reconoce por tanto que dichas funciones son idénticas a las que estarían desarrollando en su centro de trabajo y otorgan al domicilio particular la misma catalogación que cualquier otro lugar en el que el trabajador pudiera llevar a cabo las labores propias de su puesto.
