En 2014, la Consejería de Cultura, Turismo y Deporte de la Junta de Andalucía le ordenó al dueño que ejecutara unas obras prioritarias para consolidar la estructura del castillo, retirar los elementos añadidos y reforzar la cimentación. Según la administración autonómica, el coste de estas obras era de 96.980,24 euros, una cantidad que no superaba el 50% del valor del bien, que era el límite legal al que estaba obligado el propietario.

Sin embargo, el dueño recurrió esta orden ante el Juzgado de lo Contencioso-administrativo 2 de Almería, alegando que el valor real del castillo era mucho menor y que las obras necesarias eran más costosas y complejas. Además, afirmó que el estado ruinoso del inmueble era imputable a la Junta, que no había ejercido su deber de vigilancia ni había realizado ninguna actuación durante los años anteriores.
Ahora, el juzgado le ha dado la razón al propietario y ha anulado la resolución de la Junta. La sentencia, dictada el 12 de mayo y a la que ha tenido acceso Europa Press, se basa en una pericial judicial que valora el castillo en 1,1 millones de euros y estima que solo queda en pie un 28,8% del inmueble. A partir de estos datos, el fallo concluye que el coste real de las obras prioritarias asciende a 251.326,87 euros, una cifra que excede el mínimo legal del 50% al que está obligado el dueño.
