El propietario de un club de alterne en el municipio almeriense de El Ejido se enfrenta a una petición de cinco años de cárcel por parte de la Fiscalía, que le acusa de emplear a diez mujeres de origen extranjero sin darlas de alta en la Seguridad Social y sabiendo que estaban en situación irregular en España.
Según el escrito de acusación provisional, al que ha tenido acceso este medio, los hechos ocurrieron en septiembre de 2022, cuando inspectores de Trabajo y Seguridad Social, acompañados por agentes de la Policía Nacional, realizaron una inspección en el local, del que el procesado era administrador único.

En el momento de la actuación, había 13 personas trabajando en el club, pero solo dos de ellas estaban dadas de alta como trabajadoras de la mercantil, ejerciendo funciones de encargada y camarera. Las otras 11 mujeres se dedicaban al alterne, sin estar registradas ni cotizar a la Seguridad Social.
El fiscal sostiene que el acusado era consciente de su obligación de darlas de alta, pero que no lo hizo por ánimo de ilícito enriquecimiento. Además, afirma que contrató a diez de las mujeres a sabiendas de que carecían del permiso para residir y trabajar en España, favoreciendo así su permanencia irregular en el país.

Por estos hechos, el Ministerio Público le imputa un delito contra los derechos de los trabajadores en concurso ideal con un delito contra los derechos de los ciudadanos extranjeros. Además de la pena de prisión, solicita que se le imponga una multa de 3.600 euros y que indemnice a la Tesorería de la Seguridad Social con la cantidad que se determine en la ejecución de sentencia.
