En un fallo reciente, el Tribunal Superior de Justicia de Andalucía (TSJA) ha revisado y modificado la condena inicial de un hombre involucrado en una reyerta violenta ocurrida en febrero de 2022 en las cercanías de un pub en el municipio de Carboneras, Almería. El acusado había apuñalado a otro individuo en el cuello durante el altercado.

La sentencia original impuso una pena de siete años y seis meses de cárcel al agresor por un delito de homicidio en grado de tentativa. Según el tribunal, la puñalada infligida por el acusado no afectó ningún órgano vital ni puso en peligro concreto la vida de la víctima. De hecho, la herida se curó en diez días con sutura y tratamiento farmacológico. La nueva condena impuesta al agresor es de tres años y nueve meses de prisión, en lugar de los cinco años y dos meses que dictaminó la Audiencia Provincial. Además, se mantuvo la pena de dos años y tres meses de cárcel por un delito de lesiones a otro participante en la pelea.
