La juez ha considerado que no existen pruebas suficientes para condenar a los dos procesados, acusados de un delito contra la salud pública. La investigación comenzó en septiembre de 2021, cuando la Guardia Civil localizó un cultivo de marihuana en cinco invernaderos instalados en el interior de una parcela del polígono 118 de la localidad nijareña de Pujaire.

Según el informe, los procesados llegaron a este juicio por un delito contra la salud pública acusados de ser los responsables de la plantación. Sin embargo, la juez ha inciado en que no existen pruebas para condenarlos. En el caso de uno de los procesados, éste explicó que si la Guardia Civil encontró el vehículo de su madre, que él utilizaba, próximo a los invernaderos, es porque ese día había ido allí, como en ocasiones anteriores, a buscar trabajo. Aseguró que desconocía que en éstos hubiese marihuana y que la juez considera verosímil su versión dada la vida laboral aportada por este procesado y la falta de testigos y pruebas que lo relacionen con la plantación.
Respecto al segundo procesado, la juez destaca que el instituto armado únicamente intervino el material encontrado en la finca, "sin que consten vigilancias previas que permitan acreditar quien se encargaba de cultivar, cuidar o traficar con tales sustancias". La magistrada incide en que la acusación contra este hombre se sustentaba en un supuesto contrato de arrendamiento de la finca en la que estaban los invernaderos, cuya autenticidad ha sido impugnada.

El procesado aseguró que había facilitado su documentación al propietario de la finca, que estaba interesado en plantar cáñamo, a cambio de dinero, y recalcó que no había firmado contrato de arrendamiento alguno.
