En junio pasado, el Boletín Oficial de la Provincia (BOP) de Almería publicó un auto del TSJA que declaraba nulo un acuerdo del pleno del Ayuntamiento de Carboneras. Este acuerdo había declarado no urbanizable El Algarrobico, pero según la Junta de Andalucía, no cumplía con lo estipulado en la sentencia. La Junta solicitó la anulación total del acuerdo adoptado el 26 de abril y exigió que se reflejara correctamente en los documentos municipales que tanto El Algarrobico como El Canillar son terrenos no urbanizables desde 1994.
El auto del TSJA respaldó esta solicitud afirmando que existía una "extralimitación en el cumplimiento del fallo" por parte del Ayuntamiento. Según el tribunal, este no debería haber requerido aprobar definitivamente modificaciones en su PGOU más allá de simplemente incluir lo ordenado por la sentencia.
