Durante su conferencia, Muñoz Conde inició con una revisión histórica del castigo penal y analizó la evolución del ‘punitivismo’ hasta nuestros días. Destacó el concepto del ‘Derecho penal del enemigo’, desarrollado por Günther Jakobs, como un claro ejemplo de cómo se puede instrumentalizar el Derecho Penal en períodos de tensión social.
El catedrático hizo hincapié en los peligros que surgen al legislar impulsados por emociones colectivas y titulares mediáticos. Con ejemplos concretos, advirtió sobre el riesgo de que las respuestas penales se conviertan en herramientas para captar votos, lo que podría desdibujar los principios fundamentales que sustentan un Estado de Derecho. “La finalidad de la norma penal no puede ser satisfacer una demanda emocional, sino preservar las garantías que distinguen un sistema democrático de uno autoritario”, enfatizó.

Muñoz Conde también cuestionó la figura de la prisión permanente revisable, comparándola con formas de reclusión perpetua que van en contra del principio de reinserción social. Además, denunció las desigualdades en la aplicación de la justicia penal: “No es comprensible que quien hurta una cartera acabe en prisión mientras otros, que gestionan fortunas y desaparecen con ellas, logran protegerse tras estructuras opacas”.
En su exposición, evocó episodios históricos como la Ley de Vagos y Maleantes durante el franquismo para ilustrar cómo el Derecho Penal puede ser manipulado como herramienta de exclusión. “Un Derecho sin garantías no es Derecho; es poder puro disfrazado de legalidad”, subrayó.

El profesor también incorporó una perspectiva internacional a su reflexión, señalando las limitaciones del sistema judicial global ante desequilibrios de poder. Mencionó casos como el del ex primer ministro israelí Benjamin Netanyahu, quien enfrenta una orden de detención por parte de la Corte Penal Internacional pero sigue siendo recibido por gobiernos que ignoran dichas resoluciones. Resaltó que naciones como Estados Unidos, Rusia o China no han ratificado el Estatuto de Roma, evidenciando así “una arquitectura jurídica internacional aún fragmentaria y débil”.
Respecto al impacto creciente de la Inteligencia Artificial en el ámbito jurídico, Muñoz Conde argumentó que aunque esta tecnología puede desempeñar un papel técnico útil en diversos campos, el Derecho Penal requiere una interpretación humana capaz de considerar matices subjetivos que escapan a cualquier algoritmo.
