La ponencia, liderada por la vicepresidenta del TC, Inmaculada Montalbán, respalda la constitucionalidad de gran parte de esta ley, aunque también considera parcialmente tres de los motivos de inconstitucionalidad presentados por el PP en su recurso del 9 de septiembre, relacionados con detalles menores de la norma.

La ponencia que respalda el grueso de la ley será revisada en los próximos días por los diez magistrados del tribunal antes del pleno programado para el 10 de junio. Las deliberaciones comenzarán el día 24 y se espera que se extiendan hasta el 26 de junio.

El recurso presentado por el PP establece un precedente importante para las otras treinta solicitudes que están siendo tramitadas simultáneamente en el tribunal. Entre estas hay 16 recursos autonómicos, 6 cuestiones de inconstitucionalidad y 9 amparos. El recurso del PP es considerado el "recurso de cabecera" debido a las numerosas objeciones que plantea a la ley, a pesar de haber sido presentado después que otros recursos, como una cuestión de inconstitucionalidad proveniente del Supremo.
