Según documentos a los que ha tenido acceso Europa Press, la Fiscalía ha solicitado al Juzgado de Instrucción 4 de Ávila que ratifique su decisión del 12 de mayo, en la que ya se había denegado la posibilidad de que Quezada se personara como acusación particular en este procedimiento.

La acusación pública sostiene que los hechos investigados se refieren a un presunto delito cometido por un funcionario público en el ejercicio de sus funciones. De acuerdo con el artículo 443.2 del Código Penal, la Fiscalía argumenta que "no cabe entender que la personación de Ana Julia Quezada esté justificada por carecer de legitimación no ostentando la condición de ofendida o perjudicada por el hecho investigado".
Además, la Fiscalía señala que Quezada, condenada por el asesinato del niño Gabriel Ruiz, "jamás ha denunciado los hechos investigados en la fecha de su comisión". Según su declaración judicial, su relación sexual con uno de los funcionarios comenzó a principios de 2021 y le permitió recibir numerosos regalos como perfumes y bebidas alcohólicas.

El escrito fiscal continúa explicando que Quezada llegó a disfrutar "de un móvil con conexión a internet durante los meses de octubre a noviembre de 2023", el cual le fue retirado por el funcionario para evitar su descubrimiento durante un registro. Sin embargo, estos acontecimientos no fueron comunicados al Centro Penitenciario hasta finales de julio de 2024, cuando Quezada informó al educador del centro tras iniciarse una investigación después de una denuncia presentada ante la Guardia Civil por Patricia Ramírez, madre del niño Gabriel Cruz.

El Juzgado mencionado está indagando sobre las posibles implicaciones de dos funcionarios: S.T. y A.M.H. El primero ya compareció ante el tribunal el pasado 14 de mayo y se declaró inocente. Por otro lado, A.M.H., quien según Quezada le facilitó el teléfono móvil, ha sido citado para declarar como investigado el próximo 27 de junio. En esa misma fecha también deberá comparecer como testigo la novia de Quezada.
Ana Julia Quezada afirmó que recibió el dispositivo fuera del penal A.M.H., entregado por M.A.R.Q., su pareja, para introducirlo en el centro penitenciario.
