Hay días en que la política española, o más bien, su ecosistema de opinadores y afectados, parece una comedia de enredos con tintes de sainete. Pero lo ocurrido con el auto del juez Leopoldo Puente, magistrado del Tribunal Supremo que instruye el llamado 'caso Koldo', roza la perfección satírica.

El juez Puente, haciendo gala de una franqueza inusual para un auto judicial, decidió dejar constancia de su "natural estupor" por el hecho de que José Luis Ábalos, exministro de Transportes y ahora diputado por el Grupo Mixto en el Congreso, pueda seguir ostentando su escaño pese a los indicios de "graves delitos" que pesan sobre él. Y, de paso, invitó al Legislativo a una "reflexión" sobre la pertinencia de modificar la ley o el Reglamento de la Cámara Baja.
Independientemente de si el juez debería o no haber metido esa 'coletilla' –que, francamente, parece más propia de una columna de opinión que de un documento judicial y que varios juristas han calificado de "barbaridad" o "intromisión"–, lo verdaderamente hilarante es la reacción sincronizada de todo el aparato socialista.

Han salido a la palestra, como un coro griego ensayado, desde el portavoz del Grupo Socialista en el Congreso, Patxi López, hasta ministros con cartera como María Jesús Montero, vicepresidenta primera del Gobierno y ministra de Hacienda, o el ministro de Transportes, Óscar Puente (coincidencia nominal, ojo). El mensaje es unánime y contundente: ¡Separación de poderes! ¡El Judicial no puede decirle al Legislativo lo que tiene que hacer! ¡Ya vale de estas críticas!
Es, seamos honestos, cuestionable exigir la renuncia de Ábalos basándose únicamente en indicios. En este Estado español, y por fortuna, la presunción de inocencia sigue siendo un pilar fundamental. Ábalos, por muy escandaloso que resulte su caso, todavía no se ha sentado en el banquillo de los acusados y, hasta que no haya una sentencia firme en su contra, es jurídicamente inocente. Por lo tanto, sí, el juez podría haber evitado esa valoración personalísima. O, como bien apunta la lógica, si la situación le parecía tan alarmante por el "escándalo social", la ley le ofrece la herramienta de la prisión preventiva –aunque haya preferido mantener las medidas cautelares ya existentes, como la retirada del pasaporte y la prohibición de salir de España–.

Aquellos que sistemáticamente arremeten contra cualquier juez o tribunal que ose investigar o instruir causas que impliquen a algún miembro del PSOE –recordemos la crítica a los jueces que abren diligencias previas relacionadas con la esposa del presidente del Gobierno, Begoña Gómez, o con el caso que atañe a su hermano, David Sánchez, en la Diputación de Badajoz, en la Comunidad Autónoma de Extremadura–, son exactamente los mismos que ahora se llevan las manos a la cabeza por una simple opinión expresada en un auto que, además, ha sido favorable al implicado al no ordenar su prisión.
Parece que la independencia judicial y la separación de poderes son conceptos elásticos, que se defienden con fervor cuando un auto toca al poder político y lo critica, pero que se vapulean sin miramientos cuando la acción judicial afecta a los intereses del partido.
