Un exalcalde del municipio de Dalías, Jerónimo Robles, ha aceptado una pena de siete años y seis meses de inhabilitación para cualquier cargo y empleo público, además de tres meses y un día de prisión, tras reconocer los hechos en relación con la construcción "ilegal" de una guardería y una sala de usos múltiples llevada a cabo durante su mandato en 2006.

El exprimer edil, ya retirado de la política, admitió ante el tribunal de la Sección Tercera de la Audiencia de Almería su responsabilidad por un delito de prevaricación administrativa y otro de malversación, lo que ha resultado en una sentencia firme. No obstante, el tribunal ha acordado suspender la pena privativa de libertad por un periodo de dos años, condicionada a que la persona condenada no vuelva a cometer delito durante ese tiempo. Es importante señalar que, durante la tramitación del caso, el procedimiento fue archivado para otras once personas que estaban siendo investigadas, debido a la prescripción de los delitos.

La persona condenada admitió que encargó las obras de ambos espacios a una constructora sin haber iniciado ningún tipo de procedimiento administrativo previo. Los hechos se remontan a hace 19 años, cuando, en su condición de primer edil daliense, autorizó "verbalmente" a la empresa la edificación de la guardería y la sala de usos múltiples. Esta acción se llevó a cabo a pesar de carecer de la competencia necesaria para ello, pues se requería de un acuerdo plenario.
Posteriormente, se intentó financiar estas actuaciones a través de una cesión de terrenos cuyo valor ascendía a más de un millón de euros. Según el Ministerio Público, se detectaron irregularidades en los acuerdos elevados y suscritos con posterioridad, buscando aparentar una legalidad en las operaciones con la intención de pagar a la constructora mediante la permuta de parcelas y aprovechamientos de suelo público por un precio que se habría pactado entre las partes.

En este contexto, el valor real de los suelos que se buscaba entregar a la empresa como pago fue cifrado en $1.067.580,72$ euros, lo que contrastaba con los $788.572,47$ euros en que habían sido valorados, una diferencia que habría supuesto un perjuicio para el Ayuntamiento de Dalías de $279.008,25$ euros si el acuerdo hubiese prosperado. Sin embargo, la empresa constructora rechazó finalmente el acuerdo y presentó una demanda, lo que resultó en una condena para el Consistorio por parte de un juzgado de lo Contencioso-administrativo a pagar a la constructora una suma total de $993.189,92$ euros.

Las obras, que fueron "ilegalmente acordadas" y "verbalmente autorizadas", se iniciaron entre noviembre y diciembre de 2006. Posteriormente, el exregidor intentó dar "cobertura" a su actuación a través de acuerdos de Pleno que, según el texto de la información, recibieron reparos por parte de la secretaría-intervención municipal debido a su ilegalidad. A pesar de ser consciente de la ilegalidad de su proceder, se llevó a Pleno por la vía de urgencia, en mayo de 2007, un convenio urbanístico entre el Ayuntamiento y la empresa para dar cobertura a la construcción a cambio de una parcela municipal.

En esa ocasión, el secretario advirtió sobre la imposibilidad de emitir un informe de legalidad debido a la vía de urgencia de la tramitación. No obstante, la decisión no fue pospuesta, pese a que el convenio "no estaba rubricado por los intervinientes" y, supuestamente, "ocultaba la permuta ilegal de un bien inmueble", dado que la finca que se pretendía permutar "carecía de valoración". Este acuerdo, junto con una adenda ampliatoria pactada en otro Pleno el 30 de junio del mismo año, permitió la elaboración de un documento refundido con el texto definitivo del convenio urbanístico el 6 de junio de 2000, si bien la obra ya había finalizado en septiembre de 2007, aproximadamente dos años antes. El convenio final no contaba con las firmas de los intervinientes y otorgaba a la constructora la condición de propietaria de la edificación en terrenos destinados a dotaciones públicas, sin que se hubiera llevado a cabo previamente ningún procedimiento basado en los principios de publicidad y concurrencia.
